Provider’s Terms of Service

Safriat.net is an online service that enables customers to discover, compare, and book Experiences, Activities, Events, Boots, and Vacation Homes. Our Platform offers suppliers the chance to sell their services in 3 Languages (English, German, and Arabic) with a unique design.

The Website Safriat.net is owned and operated by McSa e travel solutions UG, based in Berlin, Germany.

Our aim is to offer clarity in the services which will be offered to the clients to minimize claims and bad reviews.

Suppliers must add their services in the English Language mainly, if German or Arabic text is available, it can be added directly, otherwise, our team will do the translations to other languages.


Our Terms of Service apply to suppliers and resellers as follows:

The terms “We”, “our”, “us” and “Safriat.net” refer to the services offered online under the domain name www.safriat.net which is owned and operated by McSa e travel solutions UG, which is legally registered in Berlin, Germany.
The Terms “Supplier”, and “Provider” are the service provider.

The “Agreement” of Service:
The “agreement” is applied when a Supplier /Provider/ Reseller signs up his company through our website Safriat.net.

PLEASE READ THE AGREEMENT TERMS & CONDITIONS CAREFULLY BEFORE YOU SIGN UP.

This agreement is available in English and German and is subject to the German Laws

1-  Subject of this agreement:
The “Supplier” or “Provider” has a legal company that offers services that are legally operated under the legal name of the “Supplier’s Company”.

2-  This Agreement is subject to change, if changes happened, “We” will inform our suppliers/providers of the changes, if you continue to use our services after such changes, you signify your acceptance of the adapted changes in the agreement. The date of the revision will be mentioned as “Last Updated on ….”. Suppliers have to be aware of the changes to avoid any discrepancies or legal issues.


Basics of the Agreement:
When you sign up on our website www.safriat.net, you must use the form which is dedicated to suppliers, which assures:
1-    The legal name of the company, Registration Number, VAT Tax Number, name of the person in charge, Full address, Phone Number, the email address with information about the company which will appear to the customers.
2-    After Signing up, our team will check the information of the company with the documents uploaded by the supplier.
3-    The check can take up to 3 to 5 working days by our team.
4-    By uploading the documents (Legal registration of the company, License, etc.), you are entitling us to prove your information.
5-    If the Supplier /Reseller is a tour operator a copy of the trade license from the tourism authority is required.
6-    Age of Customer/ Head Person:
We accept bookings from persons who are 18+ years old only, underage clients without parents or guardians cannot use our platform. No service will be published on our website which is declared for underage persons or children.
7-    For vacation rentals or homes, we accept only rentals which are owned and served by companies, no private owners are accepted.
8-    If the supplier is going to use our service to offer a third-party service, the supplier will be legally responsible for the content of the details and the offered service, failing to provide full information about the service might cause to suspension of the offer /supplier.
9-    The supplier is responsible for all services offered under his account on Safriat.net. this covers 3rd party services.
10-    For selected services, we might request an insurance certificate that covers the liabilities in case of discrepancies.

Customer Reviews
The reviews system on our website is based on real service users, which means that only real customer can write their reviews about the service after the end of the service.
To avoid bad reviews, we recommend taking all possible actions to keep the customer satisfied with what he paid.
Fair service conduct will be our aim always. Our team will check all reviews and will contact the supplier and customer to solve any discrepancies.

Fees/ Charges
Safriat.net is a complicated and comprehensive platform,
We rise a one-time service fee of 50 EUR for the professional translation (unless others agreed) for each language and check the quality of each offer.
Our team will check the quality of the service and will contact the supplier if they offer to miss any issue to keep high-quality standards.

Good reviews generate more business and keep a good reputation.

Commissions/ Payment:
A. If full payment is made on our website, our commission which applies is 20% (unless others agreed) from the sale fare, we pay out with bank transfer or Paypal on 15 days circle unless others agreed.
B.  If a deposit payment is made on Safriat.net, The deposit amount will be equal to our commission and we will keep it, in this case, the supplier will not get any payment from our end. The rest payment will be paid directly to the supplier.

Discounts/Coupons/ Reward Points:
Safriat.net platform offers Discount Coupons, Reward Points, and discounts.
Suppliers can apply discounts on their services by adding discounted prices with the normal fare.

Coupons:
We offer Discount Coupons that can be used for a specific service, specific time, as a part of our marketing campaigns, or to a specific customer as claim compensation.  Suppliers who wish to take part in such campaigns will be welcomed.


Reward Points:
We offer a Reward Points Programme to our clients. These points can be redeemed while the booking is placed.


•  Availability, Prices, Terms, and Conditions:
Safriat.net offer an availability calendar that supplier use to add their allotment which can be offered on our website. On this calendar, suppliers can change/amend/block available services or change the price for a special period.
Keeping the availability calendar is a must for each supplier and Safriat.net will not be liable for any overbookings or a wrong number of booked tickets/persons/services.

Prices
-Suppliers must use the same prices presented on their own website and under no circumstances should be higher than the presented prices.
According to the type of service module, we have different types of pricing possibilities. Please check the pricing possibilities according to the services you offer (experiences and activities or tours, Vacation Homes, Events, or Boats).
Suppliers can change the prices in the availability calendar according to their needs.
Safrait.net is and will not be liable for prices and if prices of the service are offered by 3rd parties, the supplier must accept the old price and no price difference on being collected from the customer. Suppliers can change their prices for new bookings.

Safriat.net will not accept price differences after selling, suppliers are liable for any differences.

Terms & Conditions of Booking:
 It is important to have clear terms and conditions for each offer you add to our website. These should include:
  Rebooking/Change/ Cancellation/Refund Policies:
   - Please add your terms and conditions for Booking Change, Cancellation, and refund for each service.
   - No Refund or cancellation is available once a service has commenced.
  No offer will be published if these policies are not added.

Booking Confirmation
-  Our System offers instant confirmation based on the availability calendar on our website.
-  When a booking is placed, an email with the details of the booking with the customer details will be sent to the supplier and this will be as a confirmed booking.
-  At the same time customer will be notified with the confirmation with the full details of the service with the supplier information.
-  If the service offer is subject to weather conditions or other conditions, these should be mentioned in a clear way in the offer with full details about the information on how customers will be informed in case of changes, and the supplier is obliged to offer an alternative date/time.
The customer has the right to cancel their booking with a full refund if they are not willing to take apart the alternative options in such a case.
-  Suppliers /Resellers must notify our team of any change or cancellation by email/phone with the procedures to protect customers.
-  In addition, suppliers must inform customers of changes, the details of the customer will be sent to the supplier in the booking E-Mail.

Cancellations due Force Major / or due to Government act:
 In case of cancellation due to unforeseeable or unavoidable external circumstances or due to government act:
o    Supplier /Resellers must offer an alternative date/time or full refund
o    If a customer rejects the alternative a full refund will be paid from Safriat.net and the supplier must pay Safriat.net back the full amount.


 Update of Information/ Offers
-  Suppliers/Resellers must update their offers by any changes, this update will not be applied to the confirmed booking/sold services, and services that are booked/confirmed/sold before the change/updates are not subject to these updates/changes. If the service cannot be offered as per the confirmation, the supplier must inform the customer which the changes with our team by email.
-  Safriat.net must be informed by the supplier of any update/change to make the necessary changes in the translations.
-  Deleting your offer:
Suppliers/Resellers can delete their offers at any time, in our platform, we use Soft Delete which keeps a copy of the offer in our database, suppliers can recover these offers at any time and can edit them before publishing them.


Invoices/ Vouchers
Safriat.net system will issue an invoice for each booking after the booking is paid, and the voucher will be generated. The voucher contains the details of the service with supplier’s contact details, meeting point, start, and end date, time of booked service, name of the head person, number of persons…
By Presenting the Voucher, the Supplier must check the documents of the customer including ID, Passport, etc. with the booking details sent by Safriat.net to avoid misuse.

Supplier Invoices:
Suppliers/Resellers must issue invoices for all booked services under the name of our company as follows:

All invoices must have the VAT Tax number of the supplier and of our company.

No Shows
If the customer does not appear at the set service time without any notice, the supplier has the right to sell the service at the last minute and the customer has no right to have an alternative date/time service (unless the supplier agrees).

Change of check-in point/time etc.:
Supplier/Resellers or their representatives must inform customers of any change in the check-in time or place.
If this is not done properly, the customer is entitled to a full refund.



Customer’s Complaints
All complaints should be dealt with from the supplier’s side, Safriat.net does not take any liability for any complaint, and any legal dispute will be resolved without any liability from Safriat.net and its operator McSa e travel solutions UG which is not responsible for any liability in respect of such complaints from customers. Safriat.net may offer customer support services and act as an intermediate between the supplier and the customer and provide an alternative service of an equal or better standard in the event of an overbooking or other complaints at the costs and expenses of the Supplier.
Insurance and Liability
Suppliers are liable according to applicable laws. The liability is excluded to the extent permitted by applicable law. The Supplier assures that all required insurances to operate the services offered through Safriat.net are made. A copy of the liability insurance can be requested by the Safriat.net team at any time according to the type of service offered.

Safriat.net is not liable for the acts, errors, or misconduct of any Supplier or for personal injuries, death, property damage, or other damages resulting from a booking through Safriat.net. Safriat.net takes no liability and will not make any refunds in the event of any delay, overbooking, or other causes beyond our direct control. Only in the cases mentioned under cancellation due force major/due Government act, Safriat.net will pay a full refund only if all attempts to reschedule or find an alternative Service failed.


Data Privacy and Data Protection of the Customer:
Safriat.net users add their personal details to register and book the services listed on our website.
Safriat.net shares important customer information with the supplier of the service booked.
Suppliers agree that they have customer data in place and will maintain adequate security procedures and controls to prevent the unintended disclosure of any personal data or information of any customer. Suppliers cannot use the customer’s data for any marketing or similar communications with any customer who booked any service through Safriat.net.
Any data misuse can lead to a legal dispute and all charges will be at the supplier’s cost, Safriat.net is not liable for any dispute.


Displayed Content and Images, Information, and Copyrights:

Images and information are very important to get business. We ask all suppliers to use actual images for the provided service. Do not use images from 3rd party for which you don’t own the copyrights.
-  Don’t search for images in search engines like Google or other search engines to use it.
-  The Information added should be also fully correct and true.
The supplier grants Safriat.net and McSa e travel solutions UG a non-exclusive, royalty-free, and worldwide right to:
•  Use, reproduce, distribute, sublicense, display, and utilize (including without limitation to modify, adapt, copy, translate and make available to the public in any manner whatsoever) the provided content like information about offers and images.
•  Safriat.net and McSa e travel solutions UG may offer this content in collaboration with affiliated companies and/or third parties.
•  Safriat.net and McSa e travel solutions UG is in no event shall be liable to the supplier for any acts or omissions on the part of any third-party platforms. The sole remedy would be to request Safriat.net (which has the right and not the obligation) to disconnect from such a third-party platform.

Marketing and Advertising
Safriat.net and Mcsa e travel solutions UG is entitled to promote the services and offers which are added by Suppliers in online marketing, including social media, E-Mail marketing, and/or PPC advertising. It is in McSa e travel solutions UG sole discretion how to advertise the services of the Supplier on its website or on third-party websites.

Use of Data for Marketing Purposes
Safriat.net uses the Supplier’s data and offers for marketing campaigns, Suppliers who agree to take part in our campaigns need to send us an email as a declaration of consent, and may revoke at any time by sending an email to supplierls@safriat.net

Usage of our Booking Engine System
The following terms of service apply to the Suppliers that use the Safriat.net online booking engine system.

Security:
Safriat.net and McSa e travel solutions use data servers hosting with firewalls and other technology to prevent unauthorized third-party access to its system and computers which are used for storing their account data as well as available encryption technology to prevent unauthorized third-party access. However, as you know 100% security on the internet is not guaranteed, Safriat.net and McSa e-travel solutions UG cannot be liable if its use of firewalls and other technologies fails to prevent unauthorized third-party access. In such a case, we will inform our suppliers and customers about the case and what is done.


Privacy and Data Protection of the Suppliers
Safriat.net's website collects different information about the various parties who utilize its services. This includes information about the Suppliers and their customers. We collect and use this information to operate our platform. Supplier information will be used in different ways such as displaying it on our website, forwarding it to customers who booked their services, sharing it with our technical support, billing and credit control, sales support, product quality upgrades, and other staff who are in acting on behalf of Safriat.net and McSa e travel solutions UG. Another reason why we keep your data is for statistical reasons. As such, we keep your data for 10 years.

Safriat.net and McSa e travel solutions UG will treat all information collected from Suppliers and their customers as strictly confidential and will never sell, rent, or lease its customer lists to third parties.
Safriat.net and McSa e travel solutions UG will not reveal, disclose, sell, or pass onto any third party (other than those who are contracted or suppliers including spam filter operators) any of the Supplier's information unless we have your express consent to do so.
We will disclose the supplier’s information, only:
•    if we are required to do so by law or legal process served on us in relation to our business or website,
•    to protect and defend the rights or property of Safriat.net and McSa e travel solutions UG,
•    if we consider it necessary to do so to enforce or apply the terms of any of our agreements with the supplier,
•    if we sell our business or part of it; and
•    in extreme circumstances, to protect the personal safety of customers who booked their services, on our website.

Upgrades & Maintenance of our Platform
Safriat.net and McSa e travel solutions UG will release modifications or upgrades to the platform but are under no obligation to do so. modifying or upgrading the system is done without your knowledge.
New features and modifications information can be listed on our website and suppliers will be informed about such changes.
Suppliers acknowledge that Safriat.net and McSa e travel solutions UG may be required to undertake scheduled or unscheduled maintenance, and this may cause interruptions to the services. You may not be able to process bookings during this time or otherwise access our website. If we scheduled maintenance, we would inform our suppliers with at least 2 days’ notice about any scheduled downtime.
For having control over your bookings and customers, you might check the booking email which is sent upon the initial booking.


No Warranty
Safriat.net and McSa e travel solutions UG does not warrant that:
•    The platform will meet your requirements and expectations.
•    The booking engine system will be compatible with your booking system or/ and communications systems.
•    Your access to the booking system will be uninterrupted or error-free.

Changes in Supplier’s Terms of Service
Our Terms of Services are subject to change without prior notice. The terms that are valid at the time of each booking shall apply. The Supplier has no claim that future bookings be completed under existing conditions.

Supplier's Account Deactivation:

Safriat.net has the right to deactivate any supplier's account that does not meet the standards or if the uploaded offer does not meet the legal standards at any time.

ln such a case, the account will be deactivated and blocked.

 

Last but not least
We call our suppliers to conduct a fair business code and to add their offers clearly, with good images.
-    We don’t accept any offer which might contain sexual or illegal activities.
